In a swift and decisive move, Kenyan authorities have taken action against Worldcoin, conducting a raid on a warehouse in Nairobi on August 5th under the authority of a search warrant. This development has raised significant concerns over the company’s data collection practices, particularly in relation to potential breaches of the country’s stringent privacy laws. The police’s operation resulted in the seizure of documents and equipment believed to store data collected through Worldcoin’s controversial iris-scanning “orbs,” a technology introduced just weeks prior in late July. The confiscated materials are now under the scrutiny of the Directorate of Criminal Investigations for further examination and analysis.

The Kenyan government had already taken a stern stance against Worldcoin last week by suspending the company’s operations due to legitimate security apprehensions. Interior Cabinet Secretary Kithure Kindiki spearheaded this decision, which is indicative of the government’s commitment to safeguarding the privacy and rights of its citizens.

Data Commissioner Immaculate Kassait emphasized that the parent company of Worldcoin, Tools for Humanity, had failed to exhibit the necessary transparency about its intentions during the registration process. Kenya’s legal framework prioritizes the privacy rights of its citizens, imposing stringent regulations that mandate the non-collection and non-disclosure of personal data unless it is unequivocally necessary. Unfortunately for Worldcoin, the practice of amassing biometric data in exchange for cryptocurrency, which the company has been employing, falls short of the threshold of necessity as defined by Kenyan regulations.

In tandem with the concerns raised by the Data Commissioner’s office, the Kenyan Capital Markets Authority has also voiced its reservations about Worldcoin’s lack of proper regulation within the country. The agency has raised the alarm about the potential risks associated with individuals willingly registering their personal data with the company, urging heightened scrutiny and caution.

Worldcoin, in response to these developments, has expressed its willingness to cooperate fully with the government’s inquiries. The company has conveyed its commitment to implementing “crowd-control measures” before recommencing its operations in the country.

It is noteworthy that Kenya is not alone in its reservations about Worldcoin’s controversial biometric data collection strategy in exchange for cryptocurrency. This project has raised concerns on a global scale, with investigations into its practices currently underway in other jurisdictions as well, including the United Kingdom, France, and Germany. Despite these concerns, it’s important to highlight that unlike in Europe, Worldcoin’s operations have not been subjected to suspension in these jurisdictions.

In a world where data privacy is of paramount importance, this incident with Worldcoin serves as a stark reminder of the need for stringent regulations and accountability in the realm of cryptocurrency and technology companies.
