It is alleged that the exchange mixed approximately $33 billion in customer assets with its own, posing a significant risk to its clients. The regulator also claims that Kraken’s lax internal controls and business practices jeopardized clients’ personal and financial information

Gurbir S. Grewal, Director of the SEC’s Division of Enforcement, condemned Kraken’s actions, stating that the exchange prioritized profits over compliance with securities laws, resulting in conflicts of interest detrimental to investors. Grewal emphasized the SEC’s commitment to holding Kraken accountable for its misconduct and sending a clear message to ensure compliance within the cryptocurrency space.

Kraken, however, remains resolute in its stance, expressing disagreement with the SEC’s allegations and vowing to vigorously defend its position. The exchange has already pledged earlier this year to cease certain securities-related services and pay a civil penalty of $30 million. Nonetheless, Kraken asserts that these changes will not affect its core product offerings and reassures clients of uninterrupted service provision.
