Three trademark applications of TRON were not accepted; undoubtedly, the rejections are a damaging blow to the blockchain platform of Justin Sun. The US Patent and Trademark Office prevented blockchain platform TRON from getting three of its trademarks passed.
Early in November, Disney claimed that TRON applications for trademarks would damage its brand and no response in this regard.
Justin Sun, CEO of TRON, is a billionaire and Chinese entrepreneur. He is known for paying $4.6 million for a Charity Lunch with Warren Buffet; however, he turned it down due to pressure from the Chinese government.
In an ICO for the TRON (TRX) in September 2017, he spent in millions in an attempt to attract several other developers to the project. Eventually, it provided for a mainstream appeal in the west.
Justin Sun Tweeted: “(2/6) When a trademark application is in the United States, it has to specify a “class” for the type of product or service that the trademark belongs to.” “(3/6) #TRON has filed trademark applications in the United States for various marks in different classes, many of which have not been challenged and are not affected by Disney.”
Tron stated that they would continue to prosecute their trademarks in the United States, further stating that they have received trademark registrations in several other countries.
Disney continues to argue that TRON, Blockchain Company is creating confusion over its brand. Disney opined that customers who are seeking “enormously successful arcade games and video games” will find that they are into Justin Sun’s project.
A notification from Disney acknowledged by Raybo technology did not file anything in return. Eventually, the patent office declared that there has been no answer to Disney’s opposition and therefore rejected all the three applications.
Jake Chervinsky, counsel at Compound, stated that “Tron did not take the trademark registration process seriously.” He added that they did not hire a US counsel to represent them. However, the USPTO explicitly ordered them to do it. No response to USPTO’s notice of default, which meant they gave up on their trademark attempt ultimately.
There was nothing wrong about abandoning a Trademark attempt when faced with a strong defense like that of Disney; however, a respectful way is to withdraw the application and not to ignore the USPTO.
TRON News tweeted: “Test-net is currently being upgraded, be prepared for an all exclusive dapp utilizing the #TRON network!” In just an hour, the entire TRON Foundation community joined with nearly 500,000 requests. The tweet stated that when they indicated a testnet that they did not expect the whole of the community to turn up.
